In the afternoon of August 14th, the government delegation led by the Prime Minister Nguyen Tan Dung had a meeting with the Ministry of Natural Resources and Environment (MONRE) to promote administrative procedure reforms in the land sector. The Minister Nguyen Minh Quang, the Vice Ministers Tran Hong Ha, Nguyen Manh Hien, Nguyen Thai Lai, Chu Pham Ngoc Hien and Bui Cach Tuyen attended the meeting.
Speaking at the meeting, the Prime Minister Nguyen Tan Dung affirmed that land is the invaluable asset and resources of the nation, the special production material, the requisition for every production operations. Therefore, the reforms of administrative procedure in this sector are essential. The administrative reforms in the land sector has to ensure simultaneously targets as simplification, minimization of nuisance and cost and furthermore contribution to the saving and effective land management
The Prime Minister praised and highly appreciated the efforts and responsibilities of the MONRE in the administrative reforms in the recent years. Especially when implementing the Land Law 2013, the MONRE has implemented a numerous reform solutions and obtained specific progress such as focus on documentation, submission and promulgation, in accordance with the legal functions and responsibilities, of implementation guidance documents of administrative procedure on land in the direction of one-door reform; ensure publicity, transparence, and convenience for people and enterprises; gradually eliminate inequalities between domestic and foreign investors
As reported by the MONRE, after promulgating the Land Law 2013, public service agencies in the land sector have been reinforced and completed; the administrative procedure has gradually been reformed in the direction of simplification, shortened implementation time, facilitated people and businesses.
Specifically, based on provisions of the Land Law 2013, the Decrees and Circulars detailing the implementation of the Law, total number of 41 administrative procedures on Land has been announced for locations where established the one-level land registration office (reduced by 33 procedures in comparison with the announced procedure set), and the total of 63 administrative procedures for the locations without the one-level Land registration office (cut-off 11 procedures in comparison with the announced one which will be end of effect by 31 December 2015).
The total time resolving land administrative procedures tends to reduce, from 2 to 25 days fewer than in the past. The MONRE has also reviewed and repealed unnecessary procedures
In the meeting conclusion, the Prime Minister suggested that the MONRE should plan for the administrative reforms in the land sector, propose specific route to create positive changes in this sector. At the same time, the MONRE should strengthen the supervising, inspecting and monitoring mechanism of implementation of regulations of land administrative procedures in local level; handle strictly and timely governmental bodies and organizations specified additional procedures and documents, as well as not strictly implemented the publicity and transparency of administration procedure.
The Ministry should develop standardized procedures; step by step set up monitoring and evaluating systems of the people and enterprises to implementation of administrative procedures of the state agencies; receive and process administrative procedures feedbacks and recommendations of individuals and organizations in accordance with the MONRE's management functions;
In order to simplify and shorten procedure time, the Prime Minister directs the MONRE to focus and accelerate the development of land information system and land database to serve multiple purposes, facilitate implementation of electronic transactions and computerization administrative procedures in the land sector
The Prime Minister asked the MONRE for focusing on instruction and guidance provinces to consolidate and reorganize the land registration offices and one-level land development agencies before 31 December 2015, as the request of the government. Particularly, the land registration office need to be consolidated as soon as possible since during the past two years, the application of this model decreases by 33 administrative procedures and from one third to a half of the implementation time.
