Dong Nai to audit environmental compliance in 2026

Dong Nai province has issued Plan No. 150/KH-UBND to inspect compliance with environmental protection laws across the province in 2026.

The plan aims to assess compliance with environmental protection (EP) laws by the inspected facilities and relevant agencies, units, organizations and individuals. Simultaneously, it seeks to rectify and raise awareness of EP law compliance, thereby enhancing the effectiveness and efficiency of state management of EP in Dong Nai province.

Inspection subjects include facilities undergoing inspection conclusions, residential projects, facilities prone to causing environmental pollution, large emission sources and active livestock farms in the province. The inspection period spans from 2024 to the time the inspection decision is executed for the inspected subjects.

The inspection duration shall not exceed 10 days. In complex cases or areas with difficult access, a one-time extension of no more than 5 days is allowed. The duration is calculated from the date the inspection decision is announced to the end of the direct on-site inspection, excluding the time for analysis, assessment, and testing of environmental samples (if any).

The Director of the Dong Nai Department of Agriculture and Environment shall issue the Inspection Decision and establish the Inspection Team. If an inspection reveals issues beyond the team's authority to consider, evaluate or clarify, the Head of the Inspection Team must report to the decision-maker to request or propose an inspection by a competent inspectorate.

Upon detecting signs of criminal offenses, the Head of the Inspection Team established by the Dong Nai Department of Agriculture and Environment is responsible for reporting to the decision-maker to recommend prosecution. The case files and relevant documents must be transferred to investigative agencies for consideration and a decision on whether to initiate a criminal case in accordance with the law.

Regarding implementation, the Director of the Department of Agriculture and Environment will direct specialized divisions to conduct inspections in accordance with the Plan issued by the Dong Nai Provincial People's Committee. Inspection funding is allocated from the state budget granted to the Department of Agriculture and Environment. The formulation, management, use and finalization of inspection funds shall be carried out per state budget laws.

In addition to the planned inspections, the Director of the Dong Nai Department of Agriculture and Environment, in the course of their duties, will conduct unscheduled environmental protection inspections. These occur when there are grounds to believe organizations or individuals show signs of violating environmental protection laws, following directives from superior agencies, upon receiving reports or petitions from organizations or individuals regarding environmental violations or in other necessary cases.
